LIMITATION OF LIABILITY

In no event is Hammerin’ Wheels, or its members, guests of members, agents, employees, or affiliates, liable for any injury or damage to a member, guest, or other person, arising out of any activity, event, or exchange associated with Hammerin’ Wheels, irrespective of any NEGLIGENCE on the part of Hammerin’ Wheels, or its members, guests of members, agents, employees, or affiliates. Each person is responsible for his or her own safety, and Hammerin’ Wheels, its members, guests of members, agents, employees, or affiliates, are in no way responsible your safety or well-being.

By agreeing to this Limitation of Liability, you HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Hammerin’ Wheels, its members, agents, employees, or affiliates FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF Hammerin’ Wheels, its members, guests of members, agents, employees, or affiliates, or BY YOUR OWN NEGLIGENCE, INCLUDING NEGLIGENT RESCUE OPERATIONS. You FURTHER AGREE that if, despite your knowing and voluntary agreement to this LIMITATION OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, you, or anyone on your behalf, makes a claim against any of the Hammerin’ Wheels, or its members, guests of members, agents, employees, or affiliates, YOU WILL INDEMNIFY, SAVE, AND HOLD HARMLESS Hammerin’ Wheels, and its members, guests of members, agents, employees, and affiliates, from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.

Hammerin’ Wheels and its agents, employees, and affiliates, do not protect, warranty, or guarantee the integrity of any parts, advice, ideas, or suggestions exchanged on Hammerin’ Wheels’ Website. Any content uploaded to Hammerin’ Wheels’ Website, including discussions, files and photographs, become the property of Hammerin’ Wheels.

The nature of bicycling activities is DANGEROUS. YOU ARE RESPONSIBLE FOR YOUR OWN SAFETY. By participating in any bicycling activity, ride, or other physical event (hereinafter “Activity”) associated with Hammerin’ Wheels, you agree, acknowledge, and represent that you are qualified, in good health, and in proper physical condition to participate in any Activity associated with Hammerin’ Wheels. You assume the risk of injury or damage associated with any Activity arising out of your participation. Hammerin’ Wheels, its members, guests of members, agents, employees, or affiliates, are in no way responsible for your safety or well-being. You agree and warrant that if, at any time, you believe conditions to be unsafe, you will immediately discontinue further participation in the Activity.

You FULLY UNDERSTAND that any BICYCLING ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“Risks”). These Risks and dangers may be caused by your own actions, or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF HAMMERIN’ WHEELS, or its members, guests of members, agents, employees, or affiliates. There may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to you or not readily foreseeable at this time, and YOU FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES you incur as a result of your participation in the Activity.

You understand that you have given up SUBSTANTIAL RIGHTS by agreeing to this Limitation of Liability. You intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. You agree that if any portion of this agreement is held to be invalid, the remaining portion(s) of this Limitation of Liability shall continue in full force and effect. You agree to participate in any Hammerin’ Wheels activities in a safe and lawful manner.
